Terms of Service

These Terms of Service govern your use of avagyans.com and the purchase of goods from Avagyans Jewelry, operated by UMAKS LLC, 27 Amiryan Street, Yerevan, Republic of Armenia. By visiting the website or placing an order, you agree to these terms.

1. Definitions

• 'We', 'us', 'our' — Avagyans Jewelry, operated by UMAKS LLC.
• 'You', 'your' — the visitor, registered account holder, or customer.
• 'Site' — the website at avagyans.com and any subdomain operated by us.
• 'Goods' — the jewelry and related items offered for sale through the Site.
• 'Order' — your request to purchase Goods, accepted by us when we dispatch a shipping confirmation.

2. Eligibility

You must be at least eighteen years old, or the age of contractual majority in your jurisdiction if higher, to place an order. By ordering, you confirm that you meet this requirement and that the information you provide is accurate.

3. The Goods We Offer

Every piece is artisan-crafted in Armenia. Gold karat, gemstone origin, carat weight, and treatment are stated in the product description. Minor natural variation in gemstones and slight differences between studio photography and the finished piece are inherent to artisanal jewelry and are not defects.

We reserve the right to decline or cancel any order where we suspect error, fraud, or violation of applicable export-control or sanctions law, and to limit quantities of rare pieces per household.

4. Pricing and Currency

Prices are displayed in the currency of your region: Armenian dram for Armenia, United States dollar for the United States, euro for the European Union, and Russian rouble for the Russian Federation. Prices include value-added tax where indicated at checkout, and are exclusive of any shipping, insurance, and destination duties unless marked Delivered Duty Paid.

We take care to ensure that prices are correct. If a pricing error is identified after you place an order and before dispatch, we will contact you with the corrected price and offer you the choice to proceed or cancel for a full refund.

5. Orders and Acceptance

Placing an order is an offer to purchase. We accept your offer only when we dispatch a shipping confirmation to you. Before dispatch, we may cancel or modify an order for reasons including stock availability, regulatory review, or suspected fraud, with a full refund of any sums paid.

6. Delivery

Delivery is managed by DHL Express through our logistics partner UMAKS LLC. Delivery windows, insurance, customs, and duties are set out in our shipping information policy. Risk of loss passes to you upon delivery to the address you provided.

7. Returns and Refunds

We offer a 30-day considered-returns window in addition to any statutory cooling-off period available in your jurisdiction. Our refund policy sets out the process, eligibility, and the treatment of customised or engraved pieces.

8. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly of any unauthorised use at security@avagyans.com. We may suspend or terminate an account that is used in violation of these terms.

9. Intellectual Property

All content on the Site — including photographs, videos, text, trademarks, product designs, and the Avagyans name and marks — is owned by us or licensed to us, and is protected by copyright, trademark, and other intellectual-property laws. You may view and copy content for personal, non-commercial use. You may not copy, republish, modify, translate, or commercially exploit content without our prior written consent.

10. Prohibited Uses

You agree not to use the Site to:

• Place orders using false or misleading information, or using a payment method you are not authorised to use.
• Interfere with the operation of the Site, including through denial-of-service attempts, scraping in violation of our robots file, or attempts to bypass authentication.
• Use the Site in connection with any unlawful purpose, including breaches of export-control, anti-money-laundering, or sanctions law.
• Infringe the intellectual-property rights of Avagyans or any third party.

11. Disclaimers and Limitation of Liability

The Site is provided on an 'as is' basis. We make no warranty that the Site will be uninterrupted or error-free.

To the fullest extent permitted by law, our aggregate liability to you in connection with any order is limited to the amount you paid for that order. We do not exclude or limit liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, or for fraud.

Nothing in these terms affects the statutory rights of consumers, including the right to remedies for non-conforming goods.

12. Governing Law and Jurisdiction

These terms and any contract of sale concluded under them are governed by the laws of the Republic of Armenia, without regard to conflict-of-law principles. Where you are a consumer, you retain the protection of the mandatory consumer-protection laws of your habitual residence.

The courts of the Republic of Armenia have jurisdiction over any dispute. Consumers may alternatively bring proceedings in the courts of their habitual residence where local law permits.

13. Changes to These Terms

We may revise these terms from time to time. The current version, its effective date, and its version number are shown at the top of this page. Changes apply to orders placed after the new version takes effect.
